Michael Jordan Tells Court He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial
The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, admitted that his competitive side and status as a newcomer motivated his push for 23XI Racing to confront Nascar over perceived violations of competition laws.
Financial Stakes and a Will to Win
The owner disclosed financial and corporate details of his racing venture, saying he invested $40 million of his own funds into the Cup Series operation co-founded with partner Polk and longtime driver Denny Hamlin.
“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I felt I could challenge Nascar as a whole. From my perspective, the sport required examination from a different view.”
The Core Dispute: Franchise System and Contract Pressure
The heart of the case involves the end of a 2016 agreement where Nascar provided each team a franchise. This system mirrors other major leagues with independent franchises, such as the NBA’s Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on charter membership renewals.
Jordan testified for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters vying for a glimpse or a photo of the sports legend.
Spearheading the Fight
Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is unlawful to maintain excessive control.

“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s executives. The response was, “If I wake up and I have 20 charters, I have 20. If there are 30, I have 30.”
