The ex-lawyer for the former president has left her position as the US Attorney for New Jersey. This follows a legal ruling that invalidated her right to serve.
Acceptance of Resignation
US Attorney General, Pam Bondi, confirmed Habba's resignation on the start of the week. Bondi stated that the judicial decision made it unworkable for her to perform her duties.
"Let no one confuse following the order as giving up," Habba stated. "This battle will now stretch across America."
Judicial Challenge
The departure was triggered by a judicial panel determined that she had been unlawfully serving as US attorney. This ruling is likely to affect many legal proceedings in the state.
The judicial panel ruled that a interim role that skirted Senate approval violated the statute on vacant positions.
Ongoing Legal Battle
The Attorney General added that she will stay on at the DOJ as a top consultant. Habba plans to seek further review of the court's action, aiming for a reversal.
Writing online, Bondi argued that the court "should not be able to countermand the executive's selection of attorneys tasked with performing the executive branch's core responsibility of criminal prosecution."
Performance in Office
She commended Habba's record and pointed out that during her run, the city of Newark saw a 20% reduction in offenses. It was also reported that the city of Camden had its first summer in 50 years without a homicide.
Background and Previous Role
Habba, first joined Donald Trump's lawyers in 2021. She later represented her client in his hush-money trial in 2024, when he was conviction on 34 counts of document fraud.
Prior to assuming the federal prosecutor position, Trump had revealed he was appointing her as his presidential counsellor in a potential future term, calling her as deeply loyal and a "tireless advocate for justice".
